Federal Judge Orders Freedom of Kilmar Abrego Garcia from Immigration Custody

A court has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement lacks lawful basis.

"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," the judge wrote in her ruling.

The case originates in a mistaken deportation to El Salvador earlier this year, which US authorities later acknowledged was an error. After his return to the United States to answer human smuggling charges, he was detained in federal detention.

In her decision, the court noted that the government does not have a current deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."
